The undersigned (“Member”), desires to become a member of Field of Dreams by Triangle Athletic Complex (“Gym”) terms and conditions:

• PHYSICAL ACTIVITY READINESS QUESTIONNAIRE: Member represents and warrants that all facts stated in the Physical Activity Readiness Questionnaire (PARQ) submitted by Member are true and correct. PARQ is incorporated herein by reference and made a part of this Agreement. Field of Dreams by TAC does not provide medical advice, diagnosis, or supervision, and  Members are solely responsible for determining their fitness for participation.

1. FACILITY AND MEMBERSHIP OVERVIEW: Field of Dreams by TAC is a self-directed fitness facility. The facility is not continuously staffed, and supervision is not guaranteed at any time. Members access the facility independently and are responsible for following all posted rules, policies, and safety guidelines.

Facility Hours: 4:00 AM – 9:00 PM – Monday – Friday 

  7:00 AM – 7:00 PM Saturday and Sunday

Short interruptions for maintenance or repairs do not qualify for refunds. If the facility is inaccessible for seven (7) or more consecutive days, Field of Dreams by TAC may provide a temporary membership freeze or extension for the impacted period.

• EVENTS/TURF USE CLARIFICATION: Certain areas of the facility, including turf areas, may be reserved for training sessions or events. Members will retain general facility access, though specific areas may be temporarily unavailable. 

• MEMBERSHIP TERM AND FEES. Membership at Field of Dreams by TAC is offered pursuant to a twelve (12) month initial membership term. Monthly membership dues are $39 per month, billed monthly, with a one-time enrollment fee of $39 due at signup.

All payments made to Field of Dreams by TAC are final and made in consideration of access to the facility and services provided. No refunds will be issued except as expressly permitted under the Early Termination provisions of this Agreement.

Membership dues are billed monthly throughout the initial 12-month term. Upon completion of the initial term, membership shall automatically renew unless properly canceled in accordance with this Agreement.

After the initial 12-month term, the Member may request cancellation by submitting a written explanation.

Access to the facility is provided via mobile access credentials. 

Personal training services are provided by approved independent trainers under separate agreements and are not included in the membership fee.

1. AUTOMATIC RECURRING PAYMENT AND MEMBERSHIP RENEWAL: Member hereby authorizes the automatic renewal of the membership and further authorizes Gym to process payment of the membership fee, via credit card or electronic funds transfer pursuant to the debit authorization form signed by Member. Member acknowledges that all payments are due in advance. 

By my signature below, I hereby acknowledge and agree to the automatic renewal of the membership on a month-to-month basis under the same conditions and monthly fee, unless properly canceled in accordance with this Agreement. I agree to provide thirty (30) days advanced written notice to cancel automatic membership renewal and automatic payments. Such notice shall be made by e-mail to the following address Team@fodsportsplex.com.

• MEMBERSHIP ACCESS. Access to Field of Dreams by TAC is provided through individual mobile access credentials issued to the Member. Access credentials are for the sole use of the Member and may not be shared, transferred, or used by any other person. Member agrees to safeguard their access credentials at all times. Sharing access credentials, propping doors, or permitting entry to non-members is strictly prohibited and may result in enforcement action in accordance with this Agreement. Member is responsible for immediately notifying Field of Dreams of any suspected unauthorized access to their account or access credentials.Field of Dreams reserves the right to suspend or revoke access credentials at any time in the event of suspected misuse, safety concerns, or violations of this Agreement.

Member agrees to defend, indemnify, and hold harmless Field of Dreams by TAC, its owners, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to the misuse, unauthorized use, or sharing of the Member’s access credentials, whether by the Member or any third party granted access by the Member, including but not limited to claims involving personal injury, property damage, or loss.

Serious violations of access and security policies may result in immediate termination of membership and may be referred to appropriate authorities where required by law.

1. GUEST PASS POLICY: Guests are permitted only through the purchase of a $10 guest pass per visit. Guests must be accompanied by the Member at all times and must complete a waiver prior to entry. Guest access may be limited or restricted at the discretion of Field of Dreams by TAC.
2. RELEASE AND WAIVER OF LIABILITY: Member acknowledges that participation in fitness activities and use of the Field of Dreams by TAC facility involves inherent risks. Member confirms that they have read, understood, and agreed to a Release and Waiver of Liability related to the use of the facility. Such Release and Waiver of Liability is incorporated by reference and made a part of this Membership Agreement.

Execution of the Release and Waiver of Liability is a condition of facility access.

• RULES AND REGULATIONS: 

Member acknowledges that Field of Dreams by TAC operates under rules and regulations established to promote safety, security, and a respectful training environment. Member agrees to comply with all rules and regulations currently in effect, as well as any reasonable updates or modifications that may be adopted and communicated by Field of Dreams from time to time. All such rules are incorporated into this Agreement by reference.

Facilities, equipment, hours, services, and policies may be modified periodically. Reasonable changes shall not constitute grounds for cancellation or refund.

Member Responsibilities & Conduct

1. Waiver Requirement
   Access to the facility is conditioned upon execution of the Release and Waiver of Liability and completion of required enrollment documentation.
2. Equipment Use
   Members shall not move, modify, or misuse equipment or use equipment in any manner inconsistent with posted instructions or common safe practices.
3. Cleanliness
   Members are required to wipe down equipment after use and maintain general cleanliness of shared spaces.
4. Care of Facility
   Members shall not abuse, damage, deface, or misuse the facility, equipment, or property. Members may be held financially responsible for damages resulting from misuse or intentional acts.
5. Dress Code
   Appropriate athletic attire and closed-toe athletic footwear are required at all times.
6. Access & Security
   Membership access is individual and non-transferable. Members shall not share access credentials, prop doors, or permit unauthorized entry. Members are responsible for ensuring doors remain closed and secured upon entry and exit.
7. Age Requirement
   All Members must be at least eighteen (18) years of age.
8. Conduct
   Members shall conduct themselves in a respectful, non-disruptive manner. Aggressive, harassing, threatening, or unsafe behavior will not be tolerated and may result in suspension or termination of membership.
9. Personal Property
   Field of Dreams is not responsible for lost, stolen, or damaged personal property.
10. Equipment Courtesy
    Members should be considerate of others and avoid occupying equipment for extended periods when others are waiting.
11. Facility Environment
    Members shall not alter facility settings, including lighting, climate controls, doors, or windows.
12. Payment Obligations
    Members are responsible for timely payment of membership dues and for maintaining current contact and billing information. Failure to maintain payment may result in suspension or termination of access.
13. Food & Beverage
    Food and beverages are not permitted. Glass containers are prohibited. 
14. Prohibited Items & Activities
    Alcohol, illegal drugs, smoking, weapons, gambling, and unsafe conduct are strictly prohibited. Members shall not use the facility while impaired in any manner that could compromise safety.
15. Photography & Recording
    Filming or photography is permitted only if not disruptive and only with the consent of any individuals captured. Filming others without consent is strictly prohibited.
16. Parking
    Use of parking areas and surrounding streets is at the Member’s own risk. Field of Dreams assumes no responsibility for vehicles or personal property.
17. Music & Audio Devices

Music and audio must be listened to through personal headphones at all times. Field of Dreams assumes no responsibility for lost or damaged personal audio devices.

Violation of these rules may result in enforcement action, including warning, suspension, or termination of membership.

10. COUNTERPARTS AND ELECTRONIC SIGNATURES: This Agreement may be executed electronically and in one or more counterparts, each of which shall be deemed an original, and all of which together shall constitute one and the same agreement.
11. HEADINGS: The section headings contained in this Agreement are for convenience only and shall not affect the interpretation or construction of this Agreement.
12. BINDING EFFECT: This Agreement shall be binding upon and inure to the benefit of the Member and Field of Dreams by TAC and their respective successors and permitted assigns.
13. ENTIRE AGREEMENT: This Agreement, together with the Physical Activity Readiness Questionnaire (PAR-Q), recurring payment authorization, and the Release and Waiver of Liability referenced herein (collectively, the “Membership Documents”), constitutes the entire agreement between the parties with respect to the subject matter hereof.

There are no other agreements, representations, warranties, or understandings, whether written or oral, relating to the Member’s membership other than those expressly set forth in the Membership Documents. This Agreement supersedes all prior agreements or understandings between the parties relating to membership at Field of Dreams by TAC.

14. GOVERNING LAW: This Agreement and all Membership Documents referenced herein shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of laws principles.
15. FURTHER ASSURANCES: The parties agree to execute and deliver such further documents and take such further actions as may be reasonably necessary to carry out the intent and purposes of this Agreement.
16. SUSPENSION AND TERMINATION: Field of Dreams by TAC reserves the right to suspend or terminate a Member’s access and/or membership for non-payment of fees, violation of this Agreement, misuse of facility access, or conduct that compromises the safety, security, or operation of the facility.

Termination or suspension of membership shall not relieve the Member of any outstanding payment obligations incurred prior to termination, except as otherwise expressly provided in this Agreement.

17. ACCEPTANCE OF TERMS: Member acknowledges that membership grants access to the facility subject to the terms of this Agreement and that membership fees and dues are owed regardless of the frequency or extent of facility use.

Member agrees to promptly notify Field of Dreams by TAC of any changes to contact information, billing information, or payment method.

By signing below, Member certifies that they have read, understand, and agree to be bound by all terms and conditions of this Membership Agreement and the Membership Documents incorporated herein. Member acknowledges receipt of a copy of this Agreement.
