By signing this agreement, I acknowledge that I am voluntarily choosing to enter and use the Triangle Athletic Complex, d/b/a Field of Dreams Sportsplex (“the Facility”) and to participate in physical activity, exercise, athletic training, open gym use, programs, events, and any related activities offered or permitted within the Facility.

I understand that participation in physical activity and use of athletic facilities involves inherent risks. These risks include, but are not limited to, muscle strains, sprains, tears, soreness, broken bones, slips, falls, collisions, equipment malfunction or misuse, heart attack, stroke, or other serious medical emergencies. I further understand that injuries may result not only from my own actions, but also from the actions or negligence of other participants. With full knowledge of these risks, I knowingly and voluntarily assume all risks, both known and unknown, associated with my participation and use of the Facility.

In consideration for being permitted to enter and use the Facility, I agree to release, waive, discharge, and hold harmless Triangle Athletic Complex, d/b/a Field of Dreams Sportsplex, the Facility’s owners, landlords, tenants, employees, agents, representatives, volunteers, independent trainers, instructors, partners, contractors, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of or related to any injury, illness, damage, or loss that I may sustain while using the Facility or participating in any activity, whether caused by negligence or otherwise, to the fullest extent permitted by law.

I understand that independent trainers, coaches, instructors, and partners may operate within the Facility and that these individuals are not employees of the Facility. Participation in partner-led training or programming is voluntary. I acknowledge that the Facility does not supervise, direct, or control the training methods or instruction of independent partners, and that this waiver applies to all activities conducted within the Facility, whether led by Facility staff or independent partners.

I agree to comply with all Facility rules, policies, procedures, posted signage, safety instructions, and codes of conduct, whether written, verbal, posted on-site, or published online. I understand that these policies may be updated or modified at any time, and that continued use of the Facility constitutes acceptance of the current policies. Failure to comply may result in suspension or termination of my access.

I understand that all equipment and facilities are provided “as is.” I agree that I am responsible for using equipment properly and safely, that I will not use equipment that appears damaged, unsafe, or unfamiliar, and that I will stop participation immediately if I experience pain, dizziness, or discomfort. I acknowledge that the Facility is not responsible for injuries resulting from misuse, overexertion, improper setup, or failure to follow instructions.

I acknowledge that I am responsible for the conduct and safety of any guest, spectator, or minor I bring into the Facility, as well as any individual who enters the Facility at my invitation or using my credentials. I understand that spectators and non-participating individuals assume all risks associated with being present in an active athletic environment, and that children and minors must be supervised at all times and may only access approved areas.

If I am utilizing the facility during unstaffed hours and I am issued a mobile credential for access, I understand that such access is personal and non-transferable, that only approved areas of the Facility may be used, that only authorized individuals may be present, and that I am responsible for securing the Facility upon entry and exit. I accept full responsibility for my conduct and safety during after-hours use and release the Facility from liability related to unsupervised access.

I understand that the Facility uses an electronic access-control and security system, to manage entry, monitor access activity, and maintain safety. I acknowledge that access credentials are personal and non-transferable, that access permissions vary by membership type and time of day, and that all entries and exits may be logged, monitored, and reviewed. I understand that propping doors, tailgating, or bypassing security protocols is prohibited, and that misuse of access credentials may result in suspension or termination of access and financial responsibility for damages or security incidents.

I acknowledge that security cameras may be in use in common areas of the Facility for safety and operational purposes, and that cameras are not placed in private areas such as bathrooms or locker rooms. By entering the Facility, I consent to video monitoring in accordance with applicable law.

I certify that I am physically and medically able to participate and assume full responsibility for my health and well-being. I understand that the Facility does not provide medical supervision, that staff are not medical professionals or first responders, and that emergency services may be contacted at the Facility’s discretion.

I understand that the Facility reserves the right to suspend or terminate my access at any time for policy violations, nonpayment, administrative issues, unsafe or disruptive behavior, or misuse of access credentials, and that such action may be taken without refund or prior notice when safety is at risk.

I agree to indemnify and hold harmless the Facility and all released parties from any claims, damages, losses, liabilities, or expenses, including attorney fees, arising from my participation, my actions or omissions, or the actions of any guest or minor under my supervision.

I grant permission, if selected, for the Facility to use photographs or video recordings taken during activities for marketing, promotional, or educational purposes without compensation.

This agreement shall be governed by and interpreted in accordance with the laws of the State of North Carolina. If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

By signing, I acknowledge that I have read this agreement carefully, fully understand its contents, and sign it voluntarily. I understand that by signing this agreement, I am waiving certain legal rights.
